RE: Past Due Accounts and Possible Lease Termination

This notice is to inform you that the moratorium that HUD set in place for evictions due to COVID-19 ends March 31, 2021.  If your account is delinquent, we are informing you of our intent to terminate your lease unless your rent and / or maintenance charges are paid in full.

We are aware of business shutdowns due to COVID-19. However, if you were affected by the shut down and was out of work, please bring in documentation that support your claim so that we can make the necessary adjustments on your account. If payment arrangements are needed, please call our office so that we may set up a payment agreement with you.

SECTION 2 (D) TERMS AND AMOUNT DUE OF LEASE STATES:

(D) Rent is due and payable in advance, without notice, during office hours on the 1st working day of each month and is delinquent if not paid by the close of business on the seventh (7th) day of each month.

SECTION 8 (A)(B) CHARGES OTHER THAN RENT OF LEASE STATES:

(A)   Charges other than rent shall be due and collectible on the fourteenth (14th) day following written notification of the charge.  Such charges shall be considered delinquent after 4:00 P.M. on the 6th business day of the month following the due date. A list of standard charges is posted in the PHA'S management office and made a part of this lease by reference.

(B)    Failure to pay for charges other than rent when due shall be considered a serious violation of the terms and conditions of this lease and will be turned over to magistrate court.

SECTION 23 (A) TERMINATION OF THE LEASE STATES:

The PHA shall not terminate or refuse to renew the lease other than for a serious violation or repeated violations of the terms and conditions of the lease such as, but not limited to:

(A)   Nonpayment of rent or other charges due under the lease or failure to pay utility bills when tenant is responsible for paying such bills directly to the supplier of utilities.
